This document is a legally binding agreement between You (the "User," "Client") and ColtNode Hosting ("ColtNode," "We," "Us," "Our"). It governs your use of and access to our website, services, and products. By accessing, using, or purchasing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

1. Definitions

  • "Service" or "Services" refers to all products and offerings provided by ColtNode, including but not limited to web hosting, game server hosting (FiveM, Minecraft), bot hosting, custom web design (LaunchHTML), and custom VPS solutions.
  • "User," "Client," or "You" refers to any individual, company, or legal entity that uses or accesses our Services.
  • "Content" refers to any data, text, files, images, code, or other materials uploaded, stored, or transmitted by you using our Services.
  • "Account" refers to the personal record created by you to access and manage your Services.

2. Acceptance of Terms

By accessing our website and using our Services, you represent and warrant that:

  • You are at least 18 years of age or have a parent or legal guardian's consent to enter into this agreement.
  • You have the legal authority to enter into this agreement and to bind yourself or the legal entity you represent.
  • You will use the Services in compliance with all applicable local, state, national, and international laws, rules, and regulations.

3. User Responsibilities and Conduct

You agree to use the Services in a manner that is both responsible and lawful. You are solely responsible for all Content and activity associated with your Account. You agree not to:

  • Use the Services for any unlawful purpose or to promote illegal activities.
  • Engage in any form of hacking, phishing, or other malicious activities.
  • Upload, transmit, or store any Content that is infringing, defamatory, obscene, pornographic, or otherwise illegal.
  • Use the Services to distribute malware, viruses, or any other harmful code.
  • Engage in any activity that disrupts or interferes with the Services or the servers and networks connected to the Services.
  • Attempt to gain unauthorized access to any part of the Services, other Users' accounts, or the computer systems or networks connected to the Services.
  • Engage in unsolicited mass email or spamming activities, including but not limited to the use of our services to send large amounts of unsolicited emails.
  • Misrepresent your identity or credentials or impersonate any person or entity.
  • Violate any applicable Acceptable Use Policy (AUP) that ColtNode may post and update from time to time.

4. Service Provision and Disclaimers

ColtNode will make reasonable efforts to provide the Services in a professional and reliable manner. However, we cannot guarantee uninterrupted or error-free access.

  • Service Availability: We may temporarily suspend or restrict access to the Services for maintenance, security, or other operational reasons. We will provide reasonable notice of such interruptions where possible.
  • Data Backups: We are not responsible for backing up your Content. You are solely responsible for creating and maintaining your own backups of all Content.
  • No Guarantees: We make no guarantees regarding the performance, uptime, or availability of our Services beyond any Service Level Agreement (SLA) that may be explicitly provided in writing for a specific Service.

5. Intellectual Property

  • Your Content: You retain all ownership rights to the Content you upload, store, or transmit on the Services. By doing so, you grant ColtNode a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your Content solely for the purpose of providing the Services.
  • ColtNode's Property: All intellectual property rights related to the Services, including but not limited to the website, software, and underlying code, are and will remain the exclusive property of ColtNode and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Services.

6. Payment and Billing

  • Pricing: All prices for our Services are listed on our website and are subject to change.
  • Payment Methods: We accept payment through our official billing portal. You agree to pay all applicable fees in a timely manner.
  • Refunds: All sales are final. We do not offer refunds unless stated otherwise in a specific Service agreement. We may, at our sole discretion, offer a refund if a Service is not provided as described and is brought to our attention within a reasonable time frame.
  • Suspension: Failure to pay for Services will result in account suspension and eventual termination.

7. Termination

ColtNode may, at its sole discretion, suspend or terminate your Account and access to the Services at any time, for any reason, including, but not limited to:

  • Violation of these Terms of Service.
  • Violation of any applicable law or regulation.
  • Non-payment of fees.
  • Engaging in activities that are detrimental to the integrity or security of our Services or other Users.

Upon termination, your right to use the Services will immediately cease. We will not be liable to you or any third party for any termination of your access to the Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COLTNODE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless ColtNode, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Services.
  • Your violation of any term of these Terms of Service.
  • Your violation of any third-party right, including, without limitation, any copyright, property, or privacy right.
  • Any claim that your Content caused damage to a third party.

10. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association (or an equivalent arbitration service). The arbitration will be conducted in a mutually agreed-upon location.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COLTNODE SPECIFICALLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Privacy Policy

Your use of the Services is also subject to our Privacy Policy, which is available on our website. Our Privacy Policy governs our collection, use, and disclosure of your personal information.

13. Changes to the Terms of Service

ColtNode reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.

14. General Provisions

  • Governing Law: These Terms shall be governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.
  • Entire Agreement: These Terms of Service constitute the entire agreement between you and ColtNode regarding the use of the Services and supersede all prior and contemporaneous agreements.
